Trading Terms & Conditions:

 

1. Returned Cheques

Any rejected cheque(s) will incur a surcharge of £ 50.00 and suspension of “cheque payment method” for up to 6 months. Subsequent second rejection(s) will incur an additional £ 50.00 charge and 1-year suspension.

Alternatively, we accept “cash” (COD) or By safest method; “direct transfer” (CHAPS or BACS) 

 

2. Returned Delivery

Unless agreed otherwise, we aim to deliver our goods within default - 48 hours. Any delivery rejected by our customer without a prior notice before vehicles set off will incur £ 30.00 surcharge.

3. Minimum Delivery 

We reserve the right not to deliver any orders under the value of £250. Minimum delivery figures to the customers based outside M25 as follows. Collection from our warehouse is available. For more information contact us on 020 8887 96 96

 

up to 10 Miles - £ 250.00

up to 20 Miles - £ 350.00

up to 30 Miles - £ 500.00

up to 50 Miles - £ 800.00

up to 100 Miles - £ 1,500.00

 

4.Last Orders

Orders via the online shop, e-mail, fax or telephone must be received before 17:00.

 

5. Returned Goods

Our drivers are only allowed to accept short life fridge products as returns. Our Sales Staff are the main point of contact for returned goods and it should be agreed. Other products will not be accepted as returns unless goods are damaged during transit.

 

6. Discrepancies

The number of packages delivered must be checked in the presence of our driver. Claims for discrepancies should be made at the time of delivery. Any claims made after drivers departure will be rejected.

 

7. Risk & Ownership

The goods shall remain the property of the Seller and be held by the Buyer as Baillie until all sums due and payable by the Buyer to the Seller have been paid.

 

8. Payment Terms

Payment terms are strictly Cash on Delivery unless credit facilities have previously been agreed.

 

9. Credit

Once an account has been authorised a credit check will be processed and you will be given a credit limit against your account; once the credit limit has exceeded then orders cannot be placed until the remaining balance has been cleared.

 

10. Prices

All goods are charged at the prices current to the date shown on the invoice

 

11. Changes to Order

The Seller reserves the right to cancel or reduce any order in the event of being unable for any reason to execute the whole or part of the order.

 

12. Delivery Fee

The Seller shall deliver to the Buyer free of charge unless otherwise stated on the face of the invoice.

 

13. Complaints

Complaints by the Buyer in respect of goods alleged to be defective shall not be a ground for the Buyer to withhold payment of accounts due to the Seller.

 

14. Late Payments

We reserve the right to charge our customer Base Rate + 1% interest on late payments.

 

15. Debt Liability 

Directors/Owners of our customers personally guarantees to settle any outstanding debt due to Dimark Ltd.

 

16. Law

All contracts provided by Dimark Ltd and Garden Foods Ltd shall be governed in accordance with English law.
